These Terms & Conditions govern all photography services provided by DK Photography, including commissioned shoots, event photography, online gallery sales, print orders and digital downloads.
By booking a session, attending an event where photography is taking place, purchasing images, or downloading digital content, you agree to these Terms & Conditions.
DK Photography attends a wide range of public and private events including dance competitions, sporting events, corporate gatherings, parties and community functions.
Where attendance is not under a paid commission, photography is provided on an independent commercial basis and images are made available for purchase.
While every effort is made to capture a broad selection of participants and moments, we do not guarantee that any specific individual, performance, group or moment will be photographed.
Photography at organised events may rely on consent arrangements made by the event organiser. Where event programmes, signage or ticket terms state that photography will take place, attendance constitutes acceptance of this.
If a parent or legal guardian requests removal of an image of their child from public display, we will remove it promptly.
We reserve the right to refuse or cease photography where circumstances compromise safety, professionalism, venue compliance or legal requirements.
For outdoor or weather-dependent events, coverage may be modified, paused or ceased where conditions pose a risk to equipment, safety or image quality.
We are not required to continue shooting in conditions that may cause equipment damage or personal risk.
DK Photography shall not be liable for reduced coverage due to adverse weather, unsafe conditions or circumstances beyond our reasonable control.
For commissioned photography (including headshots, private bookings and corporate sessions), a non-refundable booking fee of 25% may be required to secure the session date.
The remaining balance is payable prior to delivery of images unless otherwise agreed in writing.
If a client cancels a booked session, the booking fee is non-refundable. We will make reasonable efforts to reschedule where possible.
If we are unable to attend due to illness or circumstances beyond our control, we will offer rescheduling or refund any booking fee paid.
We do not guarantee a minimum number of images. Image selection and editing remain at our professional discretion.
RAW image files are not supplied.
Minor retouching may be considered upon request at our discretion. Extensive retouching or alterations may be declined.
Images are delivered via a third-party platform (currently Pixieset).
Digital downloads are made available immediately upon purchase. Where free downloads are offered, an email address may be required to access files.
Once digital files have been downloaded, the right to cancel may be waived in accordance with applicable consumer regulations.
Print products are fulfilled via a professional print lab. Colour tones may vary slightly between screens and printed products due to differences in calibration and materials. Such variations do not constitute defects.
We are not responsible for technical issues arising from third-party platforms including payment processors or hosting providers.
All images remain the copyright of DK Photography at all time.
Upon purchase, the buyer is granted a non-exclusive, non-transferable, perpetual licence to use the purchased images for personal use and commercial use, subject to the conditions below.
Permitted commercial use includes promotional and advertising use by the individual, business, school or organisation directly featured in the image.
The licence is subject to the following conditions.
Failure to provide credit will not automatically invalidate the licence; however, repeated or deliberate omission of credit may be treated as a breach of these Terms.
The licence does not permit use of the image within trademarks, logos or registered branding, nor does it permit significant alteration that materially changes the nature of the image.
Any use outside the scope of this licence requires prior written agreement.
DK Photography retains the right to use all images for portfolio, promotional and marketing purposes.
Purchased images may be shared on social media platforms.
Preview images containing watermarks must not be copied, downloaded or distributed.
Images must not be heavily altered, filtered or edited in a way that materially changes the original work.
Where reasonably practicable, credit to “dkphotographyiom” is appreciated and encouraged.
All delivered images are edited at our professional discretion.
We do not guarantee specific poses, expressions, performances or moments.
Full galleries may be provided for events; however, we do not guarantee that every individual will appear in the final collection.
RAW files are not provided.
Public galleries may be removed from view at any time.
While images may be archived for portfolio and record purposes, DK Photography does not guarantee permanent storage.
Requests for retrieval of older images may incur an administrative fee and cannot be guaranteed beyond 12 months from the event date.
For commissioned photography, our total liability shall be limited to the amount paid for that specific booking.
For event photography where attendance is independent and unpaid, our liability in relation to purchased images shall be limited to the amount paid for the specific product purchased.
We are not liable for missed shots, unphotographed individuals, subjective dissatisfaction with artistic style, or loss arising from third-
party platform failures.
We shall not be liable for indirect or consequential loss including loss of opportunity, reputation or business.
Nothing in these Terms limits liability for matters which cannot legally be excluded.
Personal data collected for bookings, purchases or gallery access is processed in accordance with Isle of Man data protection law.
Email addresses may be required to access digital downloads, including free downloads. This allows us to deliver files, maintain accountability over image distribution and, where relevant, support safeguarding responsibilities associated with event photography.
We process personal data only for legitimate business purposes including order fulfilment, communication relating to purchases, safeguarding and record keeping.
We do not sell or share personal data with third parties except where necessary to provide services (such as payment processors or gallery hosting platforms).
Personal data is stored securely through our service providers. Individuals may request access to or deletion of their personal data where applicable under Isle of Man data protection law.
These Terms & Conditions are governed by the laws of the Isle of Man.
Any dispute arising in connection with our services shall be subject to the exclusive jurisdiction of the Isle of Man courts.
